Terms of Service

1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of fe26.org, the FE26 application, and related services operated by FE26 Training (“FE26,” “we,” “our,” or “us”) (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of the Service
FE26 provides AI-assisted endurance training tools and related features for runners, cyclists, triathletes, and other multi-sport athletes. The Service may include personalized training plan generation, workout planning, progress tracking, calendar features, subscription features, and optional integrations with third-party platforms such as Strava.
We may modify, improve, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by applicable law.
3. Eligibility and Accounts
You must be at least 13 years old to create an account or use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your account information up to date.
You must notify us promptly at support@fe26.org if you believe your account has been compromised or used without authorization.
4. Strava Integration
FE26 is Compatible with Strava and may use the Strava API to sync eligible activity and profile data into your FE26 account when you choose to connect Strava. FE26 is not developed by, affiliated with, endorsed by, or sponsored by Strava. “Strava” and the Strava logo are trademarks of Strava, Inc.
By connecting your Strava account, you authorize FE26 to access and process the Strava data made available to us through Strava’s authorization flow and subject to your Strava privacy settings and permissions.
You may revoke FE26’s access to Strava at any time from your FE26 profile settings or from Strava’s connected apps settings at strava.com/settings/apps.
Your use of Strava-connected features is also subject to Strava’s own terms, privacy practices, and platform rules. FE26 does not control Strava and is not responsible for changes to Strava’s services, APIs, permissions, availability, or policies.
5. Subscriptions, Billing, and Refunds
Some features of the Service may require a paid subscription. If you purchase a subscription, you authorize us and our payment processor to charge the applicable subscription fees, taxes, and any other disclosed charges using your selected payment method.
Unless otherwise stated at the time of purchase, subscriptions renew automatically at the end of each billing period until canceled. You may cancel at any time through your billing settings. Unless required by applicable law, cancellation takes effect at the end of the then-current billing period, and we do not provide prorated refunds for unused time.
Any refunds, credits, or exceptions are granted at our sole discretion unless otherwise required by law. Questions about billing may be sent to support@fe26.org.
6. Acceptable Use
You agree that you will not:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to the Service, other user accounts, systems, or infrastructure.
- interfere with or disrupt the operation, security, or integrity of the Service.
- Copy, scrape, reproduce, resell, or redistribute the Service or Service content for commercial purposes without our prior written consent.
- Use the Service in a way that violates the terms, rights, or policies of any connected third-party service, including the Strava API Agreement and Strava privacy controls.
- Use FE26 to misuse, export, scrape, expose, or redistribute Strava-derived data in a way that violates Strava’s terms, user permissions, or applicable law.
- Use personal data or Strava-derived data obtained through the Service for advertising, data brokerage, or AI or machine learning model training.
- Reverse engineer, probe, or test the vulnerability of the Service except as permitted by applicable law.
7. Health and Fitness Disclaimer
FE26 provides training guidance, planning tools, and informational content for general informational and educational purposes only. The Service does not provide medical advice, diagnosis, or treatment, and it is not a substitute for advice from a qualified physician or other healthcare professional.
Endurance training and physical activity involve inherent risks, including the risk of injury, illness, overtraining, or death. You are solely responsible for determining whether any workout, training plan, recommendation, or activity is appropriate for you in light of your health, experience, fitness level, environment, and conditions.
Before beginning or modifying any exercise program, consult a qualified healthcare professional, especially if you have any medical condition, injury, symptoms, or other health concern. By using the Service, you assume all risks associated with your training and use of the Service.
8. Intellectual Property and Limited License
The Service, including its software, design, text, graphics, branding, interfaces, and other content made available by FE26, excluding user-provided content and third-party content, is owned by or licensed to FE26 Training and protected by applicable intellectual property and other laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.
Nothing in these Terms transfers ownership of third-party data, third-party content, or third-party trademarks to you or to FE26. All third-party names, logos, and materials remain the property of their respective owners.
9. User Content and Feedback
You retain ownership of content and information you submit to the Service, subject to any rights needed for us to operate the Service.
By submitting content, feedback, suggestions, or ideas to FE26, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display that content only as reasonably necessary to operate, maintain, and improve the Service, subject to our Privacy Policy.
If you provide feedback or suggestions, we may use them without restriction or obligation to you, provided that doing so does not override our obligations under the Privacy Policy.
10. Third-Party Services
The Service may interoperate with third-party services, sites, products, or platforms, including Strava, Google, Stripe, and others. We do not control those third parties and are not responsible for their content, availability, features, data practices, or terms.
Your use of third-party services is governed by the terms and policies of those third parties. FE26 is not liable for losses or damages arising from your use of third-party services.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, or available at all times, or that any training recommendation, generated plan, or third-party integration will meet your expectations or needs.
12. Limitation of Liability
To the fullest extent permitted by law, FE26 Training and its officers, directors, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, use, data, training progress, or other intangible losses, arising out of or related to your use of or inability to use the Service.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to FE26 for the Service in the twelve months preceding the event giving rise to the claim or (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow certain warranty exclusions or limitations of liability, so some of the above limitations may not apply to you.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FE26 Training and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of any rights of another person or entity.
14. Suspension and Termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, created legal or security risk, misused the Service, failed to pay applicable fees, or if continued access could harm FE26, its users, or third parties.
You may stop using the Service at any time. You may request deletion of your account by contacting privacy@fe26.org or using any in-product account deletion tools we make available.
Upon termination, the rights granted to you under these Terms will cease immediately, but provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, payment obligations, and dispute-related terms.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice by email, through the Service, or by updating the effective date above, as appropriate. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
16. Governing Law
These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules.
You should update this section so it matches your actual legal entity, operating location, and preferred legal forum before publishing.
17. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FE26 regarding the Service, except where additional terms apply to specific features or purchases.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision or any other right.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
